01Acceptance of Terms
By downloading, installing, accessing, or using the Kaya mobile application or the website at kaya.dlmbaccay.com (collectively, the "Service"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Kaya is developed and operated by Dominic Baccay ("Developer," "we," "us," or "our"), an independent developer based in the Philippines.
These Terms constitute a legally binding agreement between you and the Developer. Use of the Service is also governed by our Privacy Policy, which is incorporated herein by reference.
02Eligibility
To use Kaya, you must:
- 1.Be at least 13 years of age. If you are between 13 and 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service.
- 2.Have the legal capacity to enter into a binding agreement under Philippine law or the laws of your jurisdiction.
- 3.Not have been previously suspended or removed from the Service for violations of these Terms.
- 4.Agree to use the Service solely for lawful purposes.
By using Kaya, you represent and warrant that you meet all of the above eligibility requirements.
03Description of Service
Kaya is a personal expense-splitting application that enables friend groups ("barkada"), families, housemates, and other groups to:
- Create shared expense groups
- Record shared expenses and split them among group members
- Track outstanding balances between members
- Record settlements between members
- Invite new members to groups via invite links or email
- Upload receipts and payment proof photos
04Account Registration and Authentication
4.1 OAuth-Only Authentication
Kaya uses Google Sign-In and Sign in with Apple exclusively. We do not offer email/password registration. By signing in, you authorize us to receive your name and email address from the respective identity provider.
4.2 Account Responsibility
You are responsible for:
- Maintaining the security of your Google or Apple account
- All activity that occurs under your Kaya account
- Notifying us at

You may not share your account or allow others to access the Service through your credentials.
4.3 One Account Per Person
Each individual may maintain only one active Kaya account. Creating multiple accounts to circumvent restrictions or bans is a violation of these Terms.
05Groups, Expenses, and Settlements
5.1 Creating and Managing Groups
When you create a group, you become the Group Creator. As Group Creator, you have the ability to:
- Delete the group and all its associated data
- View all expenses, balances, and settlements within the group
Deletion of a group is permanent and irreversible. All expenses, splits, settlements, and associated receipts within that group will be permanently deleted for all members.
5.2 Joining Groups
You may join a group by using a valid invite link or by accepting an email invite. By joining a group, you agree that:
- Your profile (display name and avatar) will be visible to all other members of that group
- Your expenses, splits, and settlements within the group will be visible to all other members
- You will remain a member until you choose to leave or your account is deleted
5.3 Accuracy of Expense Records
You are solely responsible for the accuracy of the expense records you enter. Kaya does not verify, audit, or validate any amounts, descriptions, or splits you record. All expense data is entered at your discretion, and disputes about the accuracy of expense records are between you and the members of your group.
5.4 Settlements Are Records Only
Recording a settlement in Kaya represents your acknowledgment that a real-world payment has been made or agreed upon. Kaya does not process, facilitate, or guarantee any actual transfer of funds. If a settlement is recorded erroneously, it is your responsibility to correct it through mutual agreement with the other party involved.
5.5 No Financial Advice
Kaya does not provide financial, accounting, legal, or tax advice. Information displayed in Kaya (balances, totals, expense histories) is for informal personal tracking only and should not be used as official financial records.
06User Content
6.1 Content You Submit
"User Content" refers to any data, text, photos, or files you submit to the Service, including but not limited to: expense descriptions, group names, receipt photos, payment proof photos, and profile photos.
6.2 License to User Content
By submitting User Content to Kaya, you grant us a limited, non-exclusive, royalty-free license to store, display, and transmit that content solely for the purpose of operating and providing the Service to you and your group members. We do not claim ownership of your User Content.
6.3 Content Standards
You agree not to submit User Content that:
- Is false, misleading, or fraudulent
- Infringes any third party's intellectual property, privacy, or other rights
- Is defamatory, obscene, threatening, harassing, or discriminatory
- Contains malware, viruses, or other harmful code
- Violates any applicable law or regulation
6.4 Content Removal
We reserve the right to remove any User Content that violates these Terms or that we determine, in our sole discretion, to be harmful, offensive, or otherwise inappropriate.
07Acceptable Use
You agree to use Kaya only for lawful purposes and in accordance with these Terms. You agree not to:
- 1.Use the Service to record fictitious, fraudulent, or manipulated expenses intended to deceive other group members
- 2.Attempt to gain unauthorized access to any portion of the Service, any other user's account, or any systems or networks connected to the Service
- 3.Use the Service to harass, intimidate, or defraud other users
- 4.Circumvent, disable, or otherwise interfere with security-related features of the Service
- 5.Use any automated system, bot, or scraper to access the Service without our express written permission
- 6.Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Kaya mobile application
- 7.Use the Service in any manner that could damage, disable, overburden, or impair the infrastructure of the Service
- 8.Attempt to exploit the invite or join flow to gain unauthorized access to private groups
- 9.Upload content that infringes on copyrights, trademarks, or other intellectual property rights of any person
- 10.Use the Service for any commercial purpose, resale, or for the benefit of any third party without our express written consent
08Invitations and Email Communications
8.1 Group Invitations
When you use the invite feature to send an email invitation to a non-user, you represent that:
- You have a genuine existing relationship with the recipient
- The recipient will not consider the email unsolicited
- You are not using the invite feature for spam, marketing, or any purpose other than inviting a known individual to a shared expense group
You are responsible for ensuring that your use of the invite feature complies with applicable laws regarding electronic communications, including the Philippines' Electronic Commerce Act (Republic Act No. 8792) and anti-spam regulations.
8.2 Push Notifications
If you grant Kaya permission to send push notifications, you will receive notifications for events such as new expenses added to your groups and settlements recorded against you. You may revoke notification permissions at any time via your device settings or via the Notifications settings in the Profile screen.
09Third-Party Services
The Service relies on third-party services including Supabase (database and authentication), Google (OAuth), Apple (OAuth), Resend (email), and Expo (push notifications). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the actions, content, or privacy practices of any third-party services.
Links to third-party websites or services that may appear within the Service are provided for convenience only. We do not endorse and are not responsible for any third-party content.
10Intellectual Property
10.1 Our Property
The Kaya name, logo, design system, UI/UX, source code, and all associated intellectual property are owned by Dominic Baccay. Nothing in these Terms grants you any right, title, or interest in or to the Service beyond the limited license to use it as described herein.
10.2 Feedback
If you provide feedback, suggestions, or ideas regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, incorporate, and exploit such Feedback in any manner, without any obligation or compensation to you.
11Privacy
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the collection and use of information as described in our Privacy Policy.
12Disclaimers
We do not warrant that:
- The Service will be uninterrupted, error-free, or free of viruses or other harmful components
- Any data stored in the Service will be preserved indefinitely or will not be lost
- The Service will be available in any specific geographic location
- The balance calculations and expense splits produced by the Service are error-free or suitable for any legal or financial purpose
Kaya is a personal project maintained by an individual developer. Availability and uptime are provided on a best-effort basis and are not guaranteed.
13Limitation of Liability
This includes but is not limited to:
- Loss of data or expense records due to service interruption, account deletion, or database failure
- Financial disputes between group members arising from reliance on Kaya's balance or settlement records
- Unauthorized access to your account or group data resulting from compromise of your linked Google or Apple account
- Errors in expense splits, balance calculations, or settlement records
- Any loss, damage, or injury arising from your use or inability to use the Service
In no event shall our total cumulative liability to you for all claims exceed the amount you have paid to us for use of the Service in the twelve (12) months preceding the claim. Given that Kaya is currently a free service, this amount is zero Philippine Pesos (₱0.00) unless a paid plan is introduced and fees have been paid.
14Indemnification
You agree to indemnify, defend, and hold harmless the Developer and any affiliates, officers, agents, or contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- Your use of or access to the Service
- Your violation of these Terms
- Your violation of any applicable law or regulation
- Your User Content
- Any dispute between you and another group member arising from expense or settlement records in Kaya
15Termination
15.1 Termination by You
You may stop using the Service at any time. You may delete your account via the Profile screen in the app, which will anonymize your data as described in our Privacy Policy.
15.2 Termination by Us
We reserve the right to suspend or terminate your access to the Service at our sole discretion, with or without notice, for any reason, including if we reasonably believe you have:
- Violated these Terms
- Engaged in fraudulent or illegal activity using the Service
- Caused harm to other users or the integrity of the Service
Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination (including Sections 10, 12, 13, 14, and 17) shall survive.
15.3 Service Discontinuation
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We will make reasonable efforts to provide advance notice of material discontinuation. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
16Modifications to These Terms
We may revise these Terms at any time by updating this page. The "Last Updated" date at the top will reflect the date of the most recent revision. For material changes, we may provide notice within the app. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically.
17Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation between the parties. If negotiation fails, the parties agree to submit to the exclusive jurisdiction of the appropriate courts of the Philippines.
18Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable.
19Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Developer with respect to your use of the Service and supersede all prior or contemporaneous agreements, representations, warranties, and understandings.
